Settled: where there's a wall there's a way

18 Mar, 2010 01:00 AM
THE battle between Woolworths and the late Bert Gambrill over access to his Morisset property to complete a new shopping centre was settled out of court on Friday though details were not disclosed.

Mr Gambrill died in November aged 97 but the fight was taken up by his children.

Woolworths took Mr Gambrill to court when he refused to let the retail giant use his land to complete a $30 million shopping centre next door.

After the family rejected a temporary access rental offer, an application was made to Toronto Local Court by Woolworths subsidiary Fabcot to erect temporary scaffolding on Mr Gambrill's land to build a 13-metre wall to finish the shopping centre.

It is understood that Woolworths has since completed the development and the Gambrill property is on the market, and will be sold for commercial purposes.
